CUSTOMS CONSULTING

The amount of goods traveling within the EU and outside the EU, governed by laws and regulations that vary from state to state, the complexity of international customs procedures, necessarily require the support of a competent and qualified advice.

This short video made by the Directorate General of European Customs seemed to us the best way to represent the ecosystem of international trade where our customs consultancy activity takes place.
In this video, the intent of the highest European customs authority is to make people perceive the dimension of complexity involved in the transfer of goods operated by the countries that are part of it.

What happens at EU customs borders in a minute?

Numbers that, as you can easily understand, grow exponentially if you extend the evaluation to a global level.

The amount of goods traveling within the EU and outside the EU, governed by laws and regulations that vary from state to state, the complexity of international customs procedures, necessarily require the support of a competent and qualified consulting.

Our goal is to assist the economic operator in the correct analysis of the essential elements of the customs debtobligation of a fiscal nature (classification, origin, customs value) and extratributary (made in, dual use, reach, cites, sanitary, phytosanitary, waste, etc.).

The role of the customs agent follows the evolution of the legislation, embracing all the circumstances that precede and follow the customs moment:

  • Preferential origin og goods

Where applicable, it allows goods of this nature to obtain tariff benefits and not in the country of destination.

  • Non-preferential origin of goods

Non-preferential certificates of origin are intended to prove the commercial origin of goods (made in, TDC, anti-dumping).

  • Classification

The classification consists in assigning a numerical code to the product subject of the customs operation, in order to identify it and identify the measures provided by the legislator. A correct classification is the basis for the proper conduct of a customs operation.

  • Customs valuation

The correct valuation of goods is the crucial moment, from the tax point of view, of the customs operation. Here, competence and experience play a fundamental role in the fulfilment of tax obligations, allowing the client to pay correct amounts, without having to fear the risk of sanctions and assessments in the future.

The Customs Value is the value recognized according to specific rules of the customs sector, to imported goods for the purposes of the correct clearance and collection of Community own resources (duties) and national taxes (VAT, excise duties, etc.). It is necessary to identify the right method of determining the customs value (primary, secondary, first sale price, transfer pricing, flat rate, etc.).

  • INCOTERMS

The rules of the Incoterms of the International Chamber of Commerce (ICC) facilitate the functioning of world trade by clearly defining the respective obligations of the parties and reducing the risk of legal complications. The Incoterms rules specify the costs and risks associated with the delivery of goods from the seller to the buyer, are of a contractual nature and bind the parties only if and to the extent that they are expressly referred to in the contract.
